North castle hills neighbors working to update its deed restrictions
The current North Castle Hills (NCH) Deed Restrictions governing document is about 50 years old. Those rules, which apply to all NCH lot owners, have been amended twice in the neighborhood's history, but only for minor changes.

About 18 months ago, 80 or so homeowners attended the annual NCH picnic and business meeting where updating the official deed restrictions was the central topic of discussion. That discussion turned into a request for the NCH Homeowners Association Board to take a look at how the deed restrictions could be amended and updated.
​
Over the past year or so, the NCHHOA Board did just that and now will be bringing a proposal to the neighborhood for a vote on four separate issues neighbors requested be addressed. Before the vote goes out to the neighborhood, the board will be providing the proposed deed restrictions amendments in writing to everyone online (click the links at the bottom of this article) and by delivering a hard copy to all homes in the neighborhood.

Additionally, the board will holding a special neighborhood meeting on July 18 at the Boy Scouts camp on NW Military and offering to hold information sessions at neighbors' homes if requested. More details will be coming about the July 18 meeting. Questions and comments can also be submitted online through this website. All questions/answers and comments will be posted on the website so everyone has access to that information.

These meetings will be held after people have had about two weeks to read through the proposed deed restrictions amendments.
​
Each lot owner will have one vote (one vote per household) and you will be able to vote yes or no on each one of these amendments. The voting process will be managed by a third-party vendor to ensure transparency and accuracy in the vote tabulation.
As stated in the current legal deed restrictions, a majority of lot owners must approve any changes to the document in order for those changes to take effect. The NCH HOA will be entrusted to implement legal registration of the updated deed restrictions and to manage the implementation of all changes approved by the neighborhood.

Here is a summary of the topics being covered in the proposed deed restrictions document. You can read the complete wording of the proposed amendments by clicking the link at the bottom of the page. The proposed amendments are highlighted in blue.
Use of Land, part 1
Serves to prohibit commercial activity occurring in the homeowner’s front yard that disturbs neighbors by causing excess noise, increased traffic or unsightly storage of materials associated with the activity.
Use of Land, part 2
Serves to prohibit short-term rentals of less than 120 days. However, existing, legally permitted short term rentals by the City of San Antonio will be allowed to operate until their current City of San Antonio permit expires.
Use of Land, part 3
Serves to prohibit the use of a North Castle Hills lot for dumping or burning ground rubbish, trash, garbage, or other waste. This would not apply to bulk items and brush pickup days provided by the City of San Antonio. Homeowners may place items for those bulk pickup and brush pickup events in the locations near the curb as determined by the City of San Antonio.
Yard Signs
Serves to limit yard signs permitted in the neighborhood and requires homeowners follow state law regarding the timing allowed for the display of political signs.

Should All Homeowners Belong to the HOA?
You may remember that part of the original discussion at the last few neighborhood business meetings was whether every lot owner should be a member of the HOA. While each lot owner must comply with the deed restrictions, currently, lot owners can decide to join the HOA or not. With the dues HOA membership only being $75 per year and funds used exclusively for maintenance and operation of the neighborhood and a few social events, the clear majority of homeowners at the business meeting felt that HOA membership should be required for every lot owner. That way, all homeowners are contributing to the upkeep of the neighborhood which benefits everyone.

One clear example of the problem presented by all homeowners not belonging to the HOA occurred recently when a motorist slammed into the North Castle Hills wall at the corner of Braesview and Larkspur. That ugly mess would have sat there if the HOA didn't address it right away. The HOA paid for that repair which cost $3,500. Since only 60% of NCH homeowners belong to the HOA, 40% of homeowners here did not contribute anything to the repair of the wall. This same 60/40 payment inequity occurs for keeping the perimeter of the neighborhood mowed and cleaned each month and every other undertaking that benefits all homeowners quality of life and property values.

To address this issue, the board decided to place a NON-BINDING referendum question on the upcoming vote in August to ask neighbors whether all lot owners should be HOA members or not. That way, each homeowner will have a way to voice an opinion on the matter. That non-binding vote will give future boards a good idea of how the neighborhood feels about requiring HOA membership for each homeowner.

The financial statements and NCH Directory are in the works. They will be uploaded soon. The NCH Survey was from about 10 years ago. The issues being discussed back then are similar to what we're talking about today. We will probably want to update the survey in the next year or so.
